Terms of Service

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this eligibility requirement.

PinkSteady is a general wellness application. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease. The information and scores provided through the Service are for general informational and wellness purposes only. Always consult a qualified healthcare provider for medical concerns or before making decisions related to your health.

Certain features require you to create an account or maintain an active subscription. You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Subscriptions are billed through the Apple App Store under Apple's standard terms; cancellation and refund policies are governed by Apple.

You agree not to:

• Use the Service in any way that violates applicable law
• Attempt to reverse engineer, decompile, or extract source code from the Service
• Interfere with or disrupt the operation of the Service or the servers and networks used to provide the Service
• Use the Service to harass, abuse, or harm another person
• Resell or commercially redistribute the Service without our written consent

You retain ownership of any data, notes, or other content you submit to the Service (“User Content”). By submitting User Content, you grant PinkSteady a limited license to use, store, and process that content solely to operate, improve, and provide the Service to you, consistent with our Privacy Policy.

If you choose to link your account to a caregiver or a participating assisted living facility through the Service's connection or consent code features, you authorize PinkSteady to share your session data with that linked party for the purposes described in the Privacy Policy. You may revoke this authorization at any time from within the app.

The Service, including all software, design, text, graphics, logos, and trademarks, is the property of PinkSteady or its licensors and is protected by United States and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial use.

The Service relies on third-party platforms and providers, including Apple (App Store, StoreKit, HealthKit) and cloud infrastructure providers (such as Microsoft Azure). Your use of those platforms is subject to their respective terms. PinkSteady is not responsible for the practices of third parties.

The Service is provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure from unauthorized access, or that results obtained from using the Service will be accurate or reliable.

To the maximum extent permitted by law, PinkSteady and its officers, employees, and affiliates will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive, including ownership provisions, disclaimers, and limitations of liability.

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and may be communicated within the app. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising under or relating to these Terms will be resolved in the state or federal courts located in California, and you consent to the personal jurisdiction of those courts.
